It provides an on-line community for individuals, community organisations, voluntary organisations, small businesses and public bodies dedicated to supporting the needs of their local community.

Terms of Use

By accessing this site you accept and agree to the following terms:

1. Acceptance of Terms
1.1 Welcome to the Action For All community web portal (Action For All) provided by Community Council for Berkshire (CCB). Access to Action For All is subject to the following Terms of Service ("TOS"), which may be updated by CCB from time to time without notice to you.

1.2. You may become a registered member of Action For All by completing and submitting the ‘Member Registration’ form provided within Action For All.  Upon successful application you will receive a confirmation email advising that your registration has been successful that will be sent to the email address provided by you from the Action For All Administrator.  

1.3 A registered member may complete and submit a ‘Group Registration’ form to register a Group.  A Group may be a private or public company, a charity, a voluntary Group or statutory organisation.  Successful Group applications for registration will be notified in the same manner as set out in clause 1.2 above.  The details provided in the ‘Group Registration’ form will be displayed on a page within Action For All. This page can be accessed using the ‘Directory Search’ link on the Action For All home page.

1.4 If you wish to access the service detailed in clause 2 below (the “Service”) a licence fee is payable. 

1.5 Registered members who do not pay a licence fee will be entitled to use some of Action For All’s resources, that may include, registering a Group using a ‘Group Registration’ form, search services, subscription to the Action For All e-bulletin, access to members-only pages and personalized content (micro-site) but will not be entitled to use the Service.

2. Description of Service

2.1 Action For All provides access to a collection of resources, that may include, various communications tools (e.g. mini polls, e-bulletin, form builder, events diary, news, RSS Feeds, and complimentary subscriptions to other websites such as (CAWB4Community Funding Advice), search services, personalized content (micro-site), support and advice (the "Service"). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, shall be subject to the TOS. You understand and agree that the Service is provided "AS-IS" and that CCB assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. CCB may from time to time need to withdraw access to some or all of the complimentary subscriptions within the Service.  

3. Grant and Permitted Use

3.1 In consideration of your payment of a licence fee in accordance with clause 4 below, and subject to your compliance with the terms of this agreement, CCB hereby grants to you a non-exclusive, non-transferable licence to use the Service.  

3.2 For the purposes of this licence use shall mean and include accessing the Service via the Uniform Resource Locator (URL) www.actionforall.org.uk or any other URL that may from time to time be agreed between you and CCB. 

4. Fees and Payment

4.1 To access the Service a licence fee as detailed in the invoice is payable annually and together with VAT shall be payable within 30(thirty days) of receipt of invoice. 

4.2 CCB reserves the right to charge you interest in respect of the late payment of any sum due under these TOS (as well after as before judgment) at the rate of 4% per annum above the base rate from the due date therefore until payment. 

4.3 CCB reserves the right to suspend, interrupt or terminate the use of the Service if you are late making any payment due under this agreement. You must pay CCB a fee of £15 exclusive of VAT to re-instate use of the Service. 

5. Internet Access

5.1 You are responsible for obtaining access to Action For All and the Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees. In addition, you must provide and are responsible for all equipment necessary to access Action For All and the Service.

6. Provision of data during registration

6.1 You agree to:
(a) provide true, accurate, current and complete information about yourself and/or the Group you are registering as requested in the ‘Member Registration’ and ‘Group Registration’ form(s) (such information being the "Registration Data"); and
(b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or CCB has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, CCB has the right to suspend or terminate your membership and refuse any and all current or future use of the Service (or any portion thereof).

7. Privacy Policy 

7.1 Registration Data and certain other information about you is subject to our Privacy Policy. For more information, see our full privacy policy in Privacy Policy page.

8. Member Account, Password and Security  

8.1 You are responsible for maintaining the confidentiality of the password and username, and are fully responsible for all activities that occur under your password or username. You agree to:
(a) immediately notify CCB of any unauthorized use of your password or username or any other breach of security.
(b) ensure that you exit from your account at the end of each session.
CCB cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 8.

9. Use of Service

9.1. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not CCB, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via Action For All. CCB does not control the Content posted via Action For All and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will CCB be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via Action For All.

9.2. You agree to not use Action For All to: (a) upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; harm minors in any way; impersonate any person or entity, including, but not limited to, a CCB official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity; forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through Action For All;
(b) upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); or
(c) upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party; or
(d) upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters", "pyramid schemes," or any other form of solicitation; or
(e) upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or
(f) interfere with or disrupt the Service or servers or networks connected to Action For All, or disobey any requirements, procedures, policies or regulations of networks connected to Action For All. 

9.3. You acknowledge that CCB may or may not pre-screen Content, but that CCB and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. Without limiting the foregoing, CCB and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable.
You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

 9.4. You acknowledge, consent and agree that CCB may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to:
(a) comply with legal process;
(b) enforce the TOS;
(c) respond to claims that any Content violates the rights of third-parties;
(d) respond to your requests for customer service; or
(e) protect the rights, property, or personal safety of CCB, its users and the public.
You understand that the technical processing and transmission of the Service, including your Content, may involve:
(a) transmissions over various networks; and
(b) changes to conform and adapt to technical requirements of connecting networks or devices.

9.5 You shall document and promptly report all errors or malfunctions in using Action For All to CCB.

9.6 You shall not perform any acts referred to in clause 9.7 except to the extent and only to the extent permitted by the applicable law to you as a lawful user (i.e. a party with an express right to use) of Action For All and only then for the specific limited purposes stated in such applicable law or hereunder.

9.7 You shall not:

9.7.1. copy the content of Action For All nor otherwise reproduce the same;

9.7.2. translate, adapt, vary or modify Action For All;

9.7.3. disassemble, decompile, or reverse engineer and software relating to Action For All; or

9.7.4. not provide or otherwise make available the Service in whole or in part (including but not limited to program listings, object and source program listings, object code and source code), in any form to any person other than CCB’s employees without prior written consent from CCB. 

9.8 You shall supervise and control the use of Action For All in accordance with these TOS. 

9.9 CCB reserves the right to terminate or suspend your use of Action For All immediately if the Servers are compromised, cracked, hacked  or used inappropriately by any person in any way including but not limited to use of the Servers:

9.9.1 in a distributed denial of service attack;

9.9.2 to probe parts of other servers for vulnerability;

9.9.3 for any illegal activity; or

9.9.4 to cause network disruption.

10. Indemnity
You agree to indemnify and hold CCB, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through Action For All, your use of the Service, your connection to Action For All, your violation of the TOS, or your violation of any rights of another.

11. No Resale of Service
You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of Action For All, use of Action For All, or access to Action For All.

12. Modifications to Service
CCB reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, Action For All (or any part thereof) with or without notice. You agree that CCB shall not be liable to you or to any third party for any modification, suspension or discontinuance of Action For All.  

13. Termination
You agree that CCB may, under certain circumstances and without prior notice, immediately terminate your account, and access to Action For All. Cause for such termination shall include, but not be limited to:
(a) breaches or violations of the TOS or other incorporated agreements or guidelines,
(b) requests by law enforcement or other government agencies,
(c) a request by you (self-initiated account deletions),
(d) discontinuance or material modification to Action For All (or any part thereof),
(e) unexpected technical or security issues or problems, and
(f) extended periods of inactivity.

14. Dealings with Advertisers
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through Action For All, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that CCB shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on Action For All.

15. Links
The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because CCB has no control over such sites and resources, you acknowledge and agree that CCB is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that CCB shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

16. Intellectual Property

16.1 You acknowledge that any or all of the copyright, trademarks, trade names, patents and other intellectual property rights subsisting in or used in connection with Action For All including all documentation and manuals relating thereto, are and shall remain the sole property of CCB or its associated companies or its licensors. You shall not during or at any time after the expiry or termination of these TOS in anyway dispute or question the ownership by CCB or its associated companies or any of its licensors.

16.2 Any Content posted by you shall remain your intellectual property.

16.3  Registration data will become the property of CCB upon successful registration as per clauses 1.2 and 1.3.

16.4 You must comply with any applicable data protection laws or codes of practice in handling any personal data in connection with these TOS. You must ensure that all personal data has been captured in accordance with the Data Protection Act 1998 and any other applicable data protection laws or codes of practice.

17. Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
YOUR USE OF ACTION FOR ALL IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CCB EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. CCB MAKES NO WARRANTY THAT:
ACTION FOR ALL WILL MEET YOUR REQUIREMENTS,
ACTION FOR ALL WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE,
THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF ACTION FOR ALL WILL BE ACCURATE OR RELIABLE,
THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH ACTION FOR ALL WILL MEET YOUR EXPECTATIONS, AND
ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF ACTION FOR ALL IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

18. Limitation of Liability
NOTHING IN THESE TOS SHALL LIMIT CCB’S LIABILTY FOR DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE OR FRAUD; OR ANY OTHER LIABILITY WHICH CAN NOT BE EXCLUDED BY LAW.  YOU EXPRESSLY UNDERSTAND AND AGREE THAT CCB SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF CCB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
(i)THE USE OR THE INABILITY TO USE ACTION FOR ALL;
(ii)THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM ACTION FOR ALL;
(iii)UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
(iv)STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON ACTION FOR ALL; OR
(v)ANY OTHER MATTER RELATING TO THE SERVICE

19. Duration and Termination 

19.1 Your access to Action For All shall commence on the date that your application is accepted and shall continue conditional on your adherence to these TOS and the payment of the licence Fee (if applicable) unless terminated in accordance with the provisions of these TOS. 

19.2 You may terminate your use of the Service after expiration of the licence period (as set out in your invoice) by giving CCB at least 30 days’ notice in writing. If you give less than 30 days notice then you will be billed for the use of the Service between the expiry of the licence period and the date of the notice. If you do not give any notice then CCB will assume that you wish to renew the licence and issue an invoice for a new licence period. You will be billed for the use of the Service between the expiry of the licence period and the date of notice of termination. 

19.3 On termination of your membership CCB will hold your Content for a further 30 days during which period you may download such Content. Thereafter, CCB will be free to delete such Content and will delete it if you request it.
